Court Says, “No medicinal marijuana while on bond.” NRPC APPEALS!

Last week a medical marijuana client of ours was told by a District Court Judge that he could not ingest medicinal marijuana while out on bond pending a resolution in his Possession of Marijuana case. This, even though he possesses both a doctor’s certification and Michigan Medical Marihuana Registry Card.

Neil Rockind immediately objected to this bond condition because the defendant has legal authority, given to him by the State of Michigan, to use medical marijuana to treat a serious illness.  The Court disagreed, indicating that the defendant was precluded from violating federal law, which includes the Controlled Substances Act, which criminalizes the possession and use of ALL marijuana.

Neil Rockind, P.C. was appalled by this incorrect application of the law and immediately filed an appeal of the bond decision.
